Concerns were raised in court today over the health of the former Director of the Criminal Investigations Department, Shani Abeysekara.
The revision case filed against the High Court refusal to grant bail to Shani Abeysekara was taken up today (April 29) in the Appeal Court.
The Attorney General’s (AG) department informed the Appeal Court that the respondents wanted one more week to consider the matter.
Counsel appearing for Abeysekara told court that the situation is very unsatisfactory, as the case was being taken up for the respondents to file any objections for which ample time had been given, and that he was not in a position to accommodate further attempts to delay the determination of the matter.
He urged that Abeysekara (who has health issues) was being irresponsibly placed in grave danger especially in view of Covid-19 and that it is the responsibility of all concerned not to unnecessarily delay the matter.
Therefore, he urged the court to have the case fixed for inquiry and decision on a very early date as a matter of high priority.
The court heard submissions of all counsel and directed that the case should be taken up for inquiry on 13th May and permitted the AG to file any objections by 7th May, serving a copy on the petitioner's instructing attorney.
Viran Corea with Thilini Vidanagamage instructed by Gowry Thavarasha appeared for Abeysekara. ASG Rohantha Abeysooriya with DSG Shanil Kularatne appeared for the respondents (CID and AG). The bench consisted of Justices Bandula Karunaratne and R. Gurusinghe. (Easwaran Rutnam)
