The Supreme Court today rejected the fundamental rights petition put forward by the aunt of Makandure Madush seeking an order preventing the arrest of Makandure Madush by Sri Lankan authorities.
The fundamental right was taken up before a three-member Supreme Court bench - Justices Prasanna Jayawardena, Priyantha Jayawardena and S. Thurairajah today.
The petition in the Supreme Court sought a restraining order against the Special Task Force (STF) and Criminal Investigations Department (CID) from arresting him while in the United Arab Emirates (UAE), claiming there is no Extradition Treaty between the two countries and therefore it is illegal.
The petitioner, A.V. Sriyani of Hathporuwa, Suriyawewa had named STF Commandant DIG T.F. Latiff and four others as respondents.
In her petition, she said that since there is no extradition treaty between the two countries, she asked the SC to issue an order preventing him being arrested by the Sri Lankan law enforcement authorities. (Thilini de Silva and Ranjan Katugampola)
