SF to apply for bail

Bail applications will be filed seeking the release of former army commander Sarath Fonseka after the jail term imposed by the Court Martial against him ends tomorrow, his family members said yesterday.

Upon the completion of his jail term, he will be a normal remand prisoner and, therefore, bail applications may be filed seeking his release, they said.

While he was serving the jail term imposed by the Court Martial, he was sentenced to another three years imprisonment over the white flag case by the Colombo High Court. His lawyers have appealed against this ruling in the Court of Appeal.

Fonseka’s wife Anoma said that legal experts had said that as the Court of Appeal had not yet given its verdict regarding the ruling of the High Court and, therefore, Mr. Fonseka’s position would be that of an ordinary remand prisoner from tomorrow.

Mrs. Fonseka said her husband’s lawyers had advised her that it would be possible to apply for bail after Thursday.

Mr. Fonseka was acquitted in the Hi-Corp case by the high court on March 16 this year.

Mr. Fonseka will complete his first jail term on April 26 though he has not served 30 months as he has got time off for good behaviour. (Yohan Perera)
