Summons issued by PCoI on political victimisation

Leader of the Janatha Vimukthi Peramuna (JVP) Anura Kumara Dissanayake and former Director of CID Shani Abeysekara had yesterday filed writ petitions in the Court of Appeal seeking a court order to cancel the summons issued on them by the Presidential Commission of Inquiry (PCoI) on political victimisation.   

The PCoI issued summons on 17 parties including Dissanayake and Abeysekara to appear before the Commission on July 16 with regard to the complaint lodged by the Chairman of Avant-Garde Nissanka Senadhipathi on the alleged loss occurred to his company due to arbitrary takeover.   
Chairman of the Commission, retired Supreme Court Judge Upali Abeyratne and its members D.C. Jayatilake, Chandra Fernando, Secretary of the PCoI, Attorney General Dappula de Livera, Senior State Counsel Janaka Bandara and Chairman of Avant-Garde Nissanka Senadhipathi have been named as defendents of the writ application.   


In the petition, Dissanayake pointed out that according to the gazette notification issued on January 09 with regard to establishment of the PCoI on political victimisation, the Commission is only empowered to investigate complaints made by public servants.   


Accordingly Dissanayake mentioned that the Commission has no authority to investigate the complaint lodged by the Chairman of Avant Garde Company Nissanka Senadhipathi.  


Petitioners have requested the Court of Appeal to issue an interim order suspending the investigation into the complaint made by Senadhipathi.
