Making an undertaking the Attorney General’s (AG) Department yesterday informed the Supreme Court (SC) that Samagi Jana Balawegaya MP Harin Fernando will not be arrested until July 14 in connection with the Easter Sunday coordinated terror attack.
Representing the AG’s department Additional Solicitor General Priyantha Nawana PC made the above announcement when the Fundamental Rights petition filed by MP Fernando through his lawyers was called before the Supreme Court yesterday seeking an injunction restraining order.
The petition was taken up before a three-judge bench comprising Justices S. Thurairajah, Kumuduni Wickramasinghe and Mahinda Samayawardena.
ASG Nawana informed the Court that there was no imminent arrest of MP Fernando in connection with the Easter Sunday terror attack.
However, the ASG informed the Court that the Criminal Investigation Department (CID) wanted to record a statement from MP Fernando and added that CID would forward the investigation files to the AG’s department after recording the statement.
The ASG further stated the AG’s department will decide on the next steps to be taken with regard to the petitioner after analysing the investigation files.
The Additional Solicitor General further stated that after receiving the investigation files, the Attorney General will study them and decide on the next steps to be taken with regard to the petitioner.
Meanwhile, President’s Counsel Romesh de Silva appearing on behalf of the petitioner informed Court that he would not make any submission at the moment, as the AG’s department made an undertaking that his client would not be arrested at the moment and requested another date to consider the petition.
Accordingly, the Court had decided to postpone the case until July 14.
