Colombo, August 9 (Daily Mirror) - The Supreme Court, in two landmark judgments today, determined that the Samagi Jana Balawegaya's (SJB) decision to expel Ministers Harin Fernando and Manusha Nanayakkara from the party is legally valid.
As a result of this Supreme Court judgment, the expulsion of Harin Fernando and Manusha Nanayakkara will lead to the loss of their parliamentary seats and Ministerial portfolios.
The Supreme Court three-judge-bench comprising Justices Vijith Malalgoda, Achala Wengappuli and Arjuna Obeyesekere held that the decision made by the SJB to expel the two petitioners from the party is valid in law.
Tourism Minister Harin Fernando and Labour and Foreign Employment Minister Manusha Nanayakkkara had filed two separate expulsion petitions challenging the SJB decision to remove them from their party membership.
Faiszer Musthpha PC appeared for Manusha Nanayakkara, Romesh de Silva PC appeared for Harin Fernandp while M.A. Sumanthiran PC with Viran Corea PC, Dr. Jayampathy Wickremaratne PC, Counsel Hejaaz Hizbullah and Sampath Wijewardane appeared for the SJB leader and General Secretary.

In case you don't know. Judiciary must of independent by constitution. No need to any government to specifically allow that. I wonder if there was a time in recent months some politicians even challenged supreme court decisions, albeit under privileges.

I heard NPP leaders are saying they didn't lodge any complaint based on the findings in their files because there's no judiciary independence. I have to say that Ranil always gives 100% independence to the judiciary from the beginning. Almost all the time it hurts him dearly. But he never let his emotions interfere with his judgment. NPP files are empty and contains only fabricated lies and gossip, so if they go to courts, the cases will be dismissed at the first hearing without credible evidence, NPP is waiting for their own courts if they come to power.

In my opinion this has nothing to do with Ranil giving 100% independence to the judiciary, after the aragalaya, the Supreme Court and the justice system became strong, political interference would not have been tolerated by the court or the people. Ranil has to abide by the SC decisions and no way can he interfere, further he is only a parliament appointed President to complete someone else’s term and not a people’s elected president.

True. As long as an individual contest under a party ticket the vote should be deemed to be for the party and not the individual. Anyone wishing win a seat only on their own credentials should contest independently. The constitution should be amended accordingly. Anyone ATTEMPTING to switch parties should loose their seat forthwith. Deceiving voters should not be permitted at any cost.

Excellent judgment and we should be proud of our Judiciary. Another horrible chameleon DEALDASA insulted the judiciary as he could not grab the SLFP. This JUDGMENT has nothing to do with RANIL and another set of WAHALLU exists in the UNP too. Everyone with an atom of brains know that RANIL tried to damage the image of the Judiciary without success. Can anyone unless he is a deaf and dumb nitwit accept RANI’s proposal that the stooge in wig and gown meet the CJ and see whether something can be done after this fool did what RANIL wanted to get DESHABANDU as the IGP with the election soon. Never heard of anyone talking to the CJ over a judgment of the apex court. Our Judiciary is an ornamental and the recent judgments amply prove that.
