In a parliamentary democracy, the party that wins the most number of seats in an election is invited by the president to form the government. The UNP won the most number of seats in the last parliamentary election so MS invited RW to form the government. RW did not have to be elected as Prime Minister because in our form of government we elect the President but not the Prime Minister. The only two ways a sitting government can be defeated is in an election or through a no-confidence motion in parliament neither of which took place so this decision my MS to appoint MR as the Prime Minister is unconstitutional and should be over-turned by the Supreme Court.
