Colombo High Court ordered the heir of late Miss Sri Lanka 1962 Jennifer Ingleton to produce the purported Last Will and Testaments in the Colombo Magistrate's Court on September 22.
The Additional Magistrate made this order to Sujeewa Jayalath, the heir of Jennifer’s movable and immovable properties.
When the matter was taken up for inquiry before Colombo Magistrate's Court, Senior Counsel Shantha Herath appearing on the instructions of Counsel Muditha T. B. Ekanayake told the Magistrate that the heir for the interstate properties of late Jennifer Ingleton was not present in court due to his illness.
However, Senior Counsel Ian Fernando appearing with Thadshayaini Raj Pookash on behalf of Tony Hawke, the brother of former Miss Sri Lanka -1962 Jennifer moved court to order Sujeewa Jayalath to produce the Last Will and Testaments before the Colombo Fraud Bureau who are conducting investigations over the suspicious death of Miss Jennifer Ingleton.
Counsel Shantha Herath said his client Sujeewa will produce the last Will in court and the court would decide whether it should be handed over to the Fraud Bureau for investigation.
The Magistrate ordered the Last Will, Testament and the Medical Certificate confirming Sujeewa’s sickness should be produced in court on September 22.
Jennifer’s brother and sister-in-law had complained to the Colombo Fraud Bureau over the suspicious Last Will and the testaments alleged to have signed by Jennifer, 78-year-old widow, without any children and without any relations living in Sri Lanka. Jennifer had died under suspicious circumstances according to her brother, presently living in England.
The brother had alleged that she could have been saved if proper attention and treatment was given. He said the chaperon looked after her had not sought medical assistance deliberately in order to get hold of her assets in Sri Lanka.
Brother alleged that the chaperon had befriended Jennifer through his dancing classes to which Jennifer had gone for dancing practices.
After Jennifer being discharged from hospital last year, the chaperon had alienated Jennifer from visiting her family in Australia and her friends.
Mr. Hawke suspects that even doctors were not allowed to check Jennifer.
According to her relations after a couple of visits to them, Jennifer has not been allowed to use her mobile phone or to make phone calls or to receive phone calls since she became ill.
The relations state that the man now claims that he owns Jennifer’s properties by a questionable last will.
Attorneys-at-law Ian Fernando says that five persons had placed their signature for the questionable last will of Jennifer without including their addresses to it, which is suspicious and questionable.
Mr. Fernando said when inquiries were made from the Land Registry over the immovable properties of Jennifer it is found that the records pertaining to Jennifer's property has disappeared.(T. Farook Thajudeen)
