SC fuller bench to hear FR petition against holding Presidential election

Colombo, July 04 - The Chief Justice has nominated a fuller bench comprising five judges of the Supreme Court to hear the Fundamental Rights petition seeking an order restraining the Election Commission from taking any further steps to conduct the Presidential election in 2024.

A five-judge-bench headed by Chief Justice Jayantha Jayasuriya will hear this petition on Monday (08).

Businessman Chamindra Dayan Lenawa, a resident of Panadura is seeking an order preventing the Election Commission from holding the Presidential Election until the Supreme Court makes a determination regarding the tenure of the incumbent President.

At the moment constitutional president, Constitutional Parliament is running the govt. Leaders who got mandate from people are fired. Constitution should be respected,as per that Presidential Election also should be held in SL.Follow the footsteps of Iran, India,Russia,USA and all EU countries not forgetting the bankrupted Pakistan also held the elction in time. Cannot undertstand why SL polticians and EC are struggling to conduct all elections

Current president was elected by parliament to continue the remaining period of Elected president by people after the latter ran away. So RW does not have any more years left. If he tries to extend it by any means, it will likely lead to a bloodshed as most youth will not just wait for sure. RW is scared of elections as always. Lena is working at finance ministry. lol

In 2019, the Sri Lankan Supreme Court issued a clear ruling that the President’s tenure is restricted to five years, as per the 19th Amendment to the Constitution. Consequently Ranil has no chance of obtaining one year extension by causing a supporter to seek a ruling from our SC. I will not be surprised if very senior counsel appear as an interested party or representing UNP to submit that tenure is 6 years. All this is done to drag Ranil's tenure delaying the elections. In the 2019 application our present CJ as then AG made submissions. I hope the application will be dismissed in limine

It is sad that people do not realize this is an inconsistency in the constitution that must be settled once and for all so that no one in the future will seek refuge in it to stay on. Ranil has clearly said he will have an election this year! Despite all the hate-speech by a lot of people who are quick to write comments, Ranil has followed the constitution in its spirit!

Even after the election the same people who already elected are going to be elected to the president,s office and parliament. It is nothing will be going to happen new. Ultimately the people will have to be resorted to bear the cost of the election with their cost of living. It is an additional cost for the people. Hence, it is better to go ahead with the current development of today.

Ranil succeeded to the remaining peri od of Gotabhaya's term.Gotabhay was elected for 5 years.On what ground can anyone argue that Gotabhaya 's term should extend to six years? How can any one claim a fundamental right to have a Presidential term extended ,? This is totally insane

The Supreme Court to determine the tenure of Ranil is illegal, as Ranil is not the people elected president of Sri Lanka, but he serves as the US SLAVE to destroy the democracy of Sri Lanka, and the US conspiracy made Ranil as president is thoroughly sueable crime. So, those that filed a case in the court requiring to prevent Election Commissioner from acting his duty is too a punishable crime, therefore, please arrest that businessman-plaintiff. No one could suppress the voting rights of the people, it is an offense.
