Senaka De Silva the former secretary of Sarath Fonseka today requested the Colombo High Court for permission to visit Sarath Fonseka in Prison. However, High Court Judge Deepali Wijesundera directed him to request visiting rights from the Court of Appeal.
Colombo High Court Judge Ms. Deepali Wijesundera today made this direction on Captain Senaka Haripriya De Silva after considering the submissions of Counsel Kelum Kumarasinghe and Senior State Counsel Damith Totawatte in the case in which Sarath Fonseka and Senaka Haripriya De Silva are alleged to have provoked ten Army Officers disloyalty against the government.
Counsel Kelum Kumarasinghe making submission on behalf of Senaka Haripriya De Silva submitted that Captain Senaka Haripriya De Silva had been functioning as the Private Secretary to Former Army Commander Sarath Fonseka during the Presidential Election to this date.
The defense stated that Senaka has to meet Fonseka at the prison to discuss their political affairs, so consequently to allow him to meet Sarath Fonseka in the remand prison.
Senior State Counsel Damith Totawatte objecting to the defences’claim, submitted that the second suspect Senaka was released on bail by the Court of Appeal and if the High Court allows him to meet Fonseka it might violate the bail conditions laid by the Court of Appeal.
