Duminda will be arrested on arrival to SL

A leading lawyer Hemantha Warnakulasuriya is appearing for parliamentarian Duminda Silva in the Mulleriyawa shooting case without the written consent of Mr. Silva, a Colombo Court said today.
Colombo Additional Magistrate Prasanna Alwis made this observation while giving his order on the request made by Mr. Warnakulasuirya that the Magistrate ordered the release of certified copies of the investigation reports to Duminda Silva.
The Magistrate overruled Mr. Warnakulasuriya’s request for the investigation reports and observed that the provisions in the Penal Code only allowed the parties to obtain the copies of the JMO reports, first complaints and evidence of a case subject to certain conditions. He said they could be obtained once the suspect or suspects were indicted in the High Court. They cannot request for copies at this stage since the investigations had not been completed.
But Mr. Warnakulasuriya said there was a Supreme Court order earlier in this regard and he would give details on the next date of the case.
CID ASP Shanie Abeysekera filed the JMO’s examination report on Duminda Silva in court and said the police had recovered two vehicles and a weapon alleged to have been used in the killing of presidential adviser and former minister Baratha Lakshman Premachandra and that investigations were continuing.
ASP Abeysekera said 15 suspects had been arrested and two more were to be arrested. He said the CID conducted an operation to arrest suspect Galaboda who absconded and went into hiding in Minneriya. The suspect had escaped but his mobile phone and SIM card were recovered from the Minneriya hideout. He said according to the latest information the suspect had been abducted while in Kaduwela and the CID was on the lookout to arrest him.
The CID said Mr. Silva had been taken to Singapore and on his arrival to Sri Lanka he would be arrested. Mr. Warnakulasuriya undertook to produce Mr. Silva in court on his arrival from Singapore.
Duminda Silva’s bodyguard and police constable Anura Thushara De Mel was remanded till December 13. (T. Farook Thajudeen)
