UPFA General Secretary and Education Minister Susil Prejayantha, accompanied with Parliamentarian Wimal Weerawansa lodged a formal complaint on the candidature of General Fonseka with Elections Commissioner Dayanada Dissanayaka stating that General Fonseka had violated the election law in explaining his inability to vote before the electronic media.
Minister Premajayantha said General Fonseka has ‘cheated the entire country and kept the issue a secret until the last moment’, adding that the General should have revealed that he was not a voter on the day of nominations as other candidates including President Rajapaksa attached a copy of the extract of the electoral register with the name of the candidate to the nomination paper as required by the law.
Meanwhile International Trade and Export Development Minister Prof. G.L.Peiris raised concerns of what qualifications the General had to be a Presidential candidate.
“General Fonseka does not have qualifications for both. If he is not qualified be a voter, he does not have qualifications to be a candidate and elected. To be elected you must be an elector. It is as simple as that,” Prof. Peiris stressed.
Foreign Minister Rohitha Bogollagama added to this, “He is not a citizen of

are the legal advisers of the govt so bad that they do not know the constitution???
in chapter 7 article 30 of the constitution of the country it clearly says that any person who is a citizen of this country can contest the presidential election as long as he is nominated by a recognized political party and above the required age.
only if he is a independent candidate that he has to be registered in any electoral register.
wonder where they got their qualifications from for practicing law if they do not know the constitution even...

What a culture we have in this nation. i am truly madly deeply sorrowed by the way these politicians are behaving. me thinks kinder garden kids are better in terms of attitude than these grown ups. sore losers!
1 0
Tuesday, 26 January 2010 03:43 PM
We should be grateful, Sarath Fonseka chose the ballot box, even though he is not qualified, to reign over Sri Lanka. With his mindset, the other alternative is Coup d'Etat which he had also allegedly contemplated but dropped as he had not the requisite support from neither the Army, Navy nor Air Force. A military junta is all we need like a hole in the head.

If you can't win by ballot, try win by bullet. When the Election Commissioner says that SF is eligible, how can anyone else contest that. After all it was EC who accepted the nominations, when there was an objection from Sarath Koongahage. SO Election Commissioner should be right.
1 0
Tuesday, 26 January 2010 03:47 PM
SO MR GOING TO LOOSE THE ELECTION
CONGRATS SF!!!!!!!!!!!!!!!
1 0
Tuesday, 26 January 2010 03:47 PM
This is proof that Govt has already accepted defeat even before vote counting has started. They used all their trump cards and this one is their last which will get them nowhere. Election Commissioner has already declared that being not a registered voter is not a disqualification to be a Presidential candidate. What a comedy?

Tuesday, 26 January 2010 03:48 PM
I hope the Govt. is just joking.
If legal action is to taken, then SF should sue the govt. for not producing the correct documentation. He is a citizen who almost died in defending the country. He held a very senior govt. position. He is not even a dual citizen.
People who do not know international law, must not speak irresponsibly.
If this is seriouse, then Gota and MRs other brothers and some cabinet ministers who hold Dual Citizenships, also should be sued together with the Commissioner of Elections.
People like Weerawansa, who is more a clown than a politician, should not open mouths so irresponsibly.
1 0
Tuesday, 26 January 2010 03:49 PM

The government will try its best to unseat SF. How come they thought of it only at this juncture? Very funny, very funny indeed. The Elections Commissioner has ruled it out anyway and has said that it was not necessary to be a registered voter to contest an election. Only be a citizen. SF is a citizen.
1 0
Tuesday, 26 January 2010 03:56 PM
SF is not a fool. He always consults his lawyers, and in this case he would have definitely consulted his lawyers on his US immigration status vs voting in SL. The rule in US is that, if you are seriously planning to seek a office in the US -- especially in the federal government -- it is extremely possible that having a second citizenship may be a serious liability. Hence, we should NOT be idiots NOT to understand why he refrained from being a voter in SL. His love is USA.

I like SF, even more, after this ! ! ! Completely Apolitical, exactly what we need ! About SF losing his home town - the real losers are the people of Ambalangoda. IF SF loses this election, the REAL losers will be the people of Sri Lanka. E.g. 100+ RICH ministers ?

As a presidential candidate it was SF responsibility to reveal the truth to the public that he was not a registered voter. If he was a genuine person and wanted remove corruption the voters had the right to know about this before 26/01/2010. This is to show that he was power hungry and wanted revenge and deceives people to vote for him without disclosing that he is not able to vote yesterday. All the people around him would have known this secret.

Who is this legal eagle whgo is advising the govt. to do this. Who every it is needs to go back to law school and take lessons. One does not need to be a registered voter for you to contest. If a person is a citizen of S.L. any person can contest. If they do not have the brains to know this then god help our country as we are being ruled by a set of fools.

Re-reading on what has been "said" - viz being "not a citizen of Sri Lanka" may drag us into another problem.
That is we are employing mercenery solders.
This, as far as I know , reflects bad on a country.

Thank you SF for insulting the intelligence of 4 million Sri Lankans who voted for you. MR made you who you were until 26Jan. But your downfall is your own fault !! You cannot balme Ranil, Soma, Rauf, Mangala et al for this !! If at all, you destroyed whatever credentials the UNP, JVP and SLMC had. You will not be able to face any Sri Lankans from 27Jan.

I would not blame Fonseka for getting a Green card if the people who support Rajapakse are all like the people who comment in this newspaper. Fonseka was good enought o get injured, leading the SL Army in the War to free Sri lanka of terrorists, but not good enough to contest a presidential Election to rid the country of people like Rajapakse's supporters. If Rajapakse loses, will he too get a Green Card, or has he already got one like his brothers?

hmmmmmm...... well.... thank GOD i dont personally expect anything from the party or elected, but we should think about the country and the well being of it. we cannot let it fall in to people who will destroy its image to the world.. it simply cannot.
