The lawyer of the Army Major, who was injured during a brawl at JAIC-Hilton Colombo, filed an affidavit before the Colombo Fort Magistrate today stating that Malaka Silva and Rehan Wijeratne did not assault him.
The affidavit also stated that five others, who are in the remand prison, have assaulted him and also agreed to settle the matter amicably. In his motion before Colombo Fort Magistrate Kanishka Wijeratne, counsel Dinesh D. Dodamgoda appearing for the aggrieved party informed that his client Major Chandana Pradeep Susena had decided to arrive at an amicable settlement with the consent of both parties.
According to the affidavit attested by Commissioner of Oaths R.S.A. Kottelawala, the complainant said though Malaka Silva and Rehan Wijeratne were present at the hotel, they were not involved in assaulting him and even did not aid or abet in the commission of the offence. He said some of the others who were at the hotel might have assaulted him. Cont. From page 1
The army major said the lawyers of the two parties would discuss the settlement.
The Major said that though he had alleged that his gold chain was robbed by someone at the hotel he had later found it at his residence.
Filing a motion, counsel Dodamgoda moved Court that the case be taken up tomorrow and notice be issued on the complainant party to appear in Court. Having considered the submissions, the Magistrate ordered the Court Registrar to issue notice on Major Chandana Pradeep Susena through the Commanding Officer of the Army Hospital requesting that he appears in court on September 24(Lakmal Sooriyagoda)

I was reading with interest the comments made by readers over this case since it started, most stated the obvious, i.e. that the army general will eventually say that he was not assaulted and it has come to fruition. Hats off to the readers, you'll know exactly the country/the system. Nevertheless, I like reading any article on Dr Mervin because I enjoy all the readers comments on anything he does or says as he is certaily a funny man and most of the readers comments make me laugh ha ha!

2. If so had he forgotten to protect himself?
3. Did he go to the hotel far a shady deal?
4. Who hit him ? or were the reports false?
5. Was he alone or were there no witnesses, The CCTV?
6. What about the report he had made about the assault?
Finally the Army is made up of Soldiers. After the war we were proud of our Army. But today Shame! Shame on you.

This Major is a poor pawn threatened and humiliated by his superiors and the powers that be,{ if he does not whitdraw his original statement to the pollice that he was assaulted by Malaka and Rehan}.. This fool will be in real trouble now if he made a false. statement in his afidavit. The Doctor who certfied that these two thugs were sick and must be admittedto the hospital has a lot to answer too. His diagnosis should be examined by a neutral specialist. How come these thugs partying at a nightclub with drinks and women suddenly fell ill, The same ruse made by criminals when arrested and put in jail. Justice in Silly Lanka ?
