Commercial High Court vacates enjoining order issued against Planto Ceylon

The Commercial High Court of Colombo yesterday made an order to vacate the enjoining order issued against Planto Ceylon (Pvt.) Ltd and its directors (defendants), which prevented them from manufacturing, selling, marketing and distributing their beverage ‘KicoVera’.  
The court had earlier issued an enjoining order under a lawsuit filed by Silvermill Natural Beverages (Private) Limited, under Intellectual Property Act No. 36 of 2003, on the basis of infringement of the plaintiff’s intellectual property rights.  
Making submissions on behalf of the defendants, Dinal Phillips PC said that the plaintiff had suppressed facts to the court. After considering the same, the Commercial High Court decided to vacate the enjoining order.  

The defendants were represented by Dinal Philips PC, with Shalani Gunawardena AAL, Thevuni Amaradasa AAL and Tirashi Fernando, on the instructions of Invictus Law.
