Dubai Company’s claim for US$ 50,000.00 from a Sri Lankan Company dismissed

In a case filed by a Dubai Company claiming US$ 50,000.00 from a Sri Lankan businessmen over a transaction between them.  In this case Euro Capital ,Building 4 Emaar Business Park of Dubai had sued two Sri Lankans namely Jicker Cassim and his son Mohamed Shakeel Cassim for the recovery of sum of US$50,000.00 from the defendants under the trade finance agreement entered between the plaintiff Dubai company and the defendants.  

The Plaintiff Company had alleged that all claims stemmed from the supply of goods by the plaintiff to the defendants.   


The plaintiff had filed this action in respect of an agreement entered into between the Plaintiff and the two defendants . The plaintiff had claimed that the plaintiff had offered trade services and finance facilities to the defendants and the business the defendants carried out.   


   The Judge observed that although the plaintiff’s witness stated that the goods were purchased upon request made by the defendants no documentary evidence was provided to prove the same. Hence judge Pradeep Hettiarachchi dismissed the plaintiffs action.
