Action against Schools Cricket Association dismissed

An Action filed by the former Secretary of the Sri Lanka Schools Cricket Association (SLSCA) Dilshan De Silva against the SLSCA was withdrawn and accordingly the action was dismissed by the Colombo District Judge Hon. R. L. Godawela on October 12, 2020.

Previously, in 2019, the then President of the SLSCA Oshara Panditharathna had sought to temporarily suspend the functions of the Secretary, upon a disciplinary committee report, pending an inquiry by the Executive Committee and the Ministry of Education in relation to certain financial irregularities.

The Plaintiff had originally obtained an Interim Injunction. Thereafter, when the case came up for Answers of the Defendants, it was pointed out to Court that the action cannot be proceeded with since the Office Bearers of SLSCA had changed and a new President, Secretary and Treasurer appointed. Furthermore, it was submitted that since the SLSCA is an unincorporated association, steps have to be taken in compliance and an amended caption to be submitted if the Plaintiff were to proceed with the case. The Plaintiff also submitted that the Office Bearers had changed. Thereafter on October 12 the Plaintiff moved to withdraw the case and accordingly the said action was dismissed by Court.

The Plaintiff was represented in Court by Hilary Livera. Counsel Hiran de Alwis and Kusal Kuruwita, instructed by Mr. Presanna Ekanayake, appeared for the Defendants including the former President, Treasurer and Office Bearers of the SLSCA.
